Article 2 – Purpose and scope
The purpose of these General Terms and Conditions of Sale is to define the conditions applicable to the distance sale of creations offered by Maison Distinguée, in particular custom-made wedding dresses and personalized creations.
Maison Distinguée primarily offers two types of orders:
1. Models from the catalog
The customer selects a model presented on the website. The dress is then made specifically according to the individual measurements provided during the ordering process.
These models can be ordered directly from the website, subject to the conditions and options offered.
2. Custom creations
The client can request a specific creation or specific modifications to an existing model.
These requests are subject to a preliminary study and, where applicable, a personalized quote specifying the characteristics of the creation, its price and the conditions of realization.
These General Terms and Conditions apply to orders placed directly on the website www.maisondistinguee.com as well as to orders concluded remotely following exchanges with Maison Distinguée, in particular by WhatsApp or by email, subject to their communication and acceptance by the customer.
All orders imply acknowledgment and acceptance of these Terms and Conditions under the conditions set out in the order process.
Maison Distinguée reserves the right to modify its Terms and Conditions. The terms applicable to an order are those accepted by the customer at the time of its placement. Subsequent modifications do not apply retroactively to orders already placed.
Article 3 – Contract Formation and Order Validation
3.1. Orders placed on the website
The customer can select a creation, view its characteristics and price, add it to her basket and proceed to validate her order.
Before final validation, she must be able to check the summary of her order, including the selected items, their essential characteristics, the total amount to be paid, the applicable fees and the delivery information.
Final validation occurs through an action explicitly indicating the obligation to pay.
The order is confirmed in accordance with the online sales process, and a confirmation is sent to the customer on a durable medium, including by email.
Creating a customer account is not mandatory when the site allows ordering without an account.
3.2. Custom orders based on a quote
For fully customized creations or specific modifications requiring prior study, Maison Distinguée can provide a quote.
The quote specifies, in particular, the nature of the creation, the agreed elements, the price and the payment terms.
The order is concluded after acceptance of the quote and according to the validation and payment conditions indicated therein.
Written exchanges identifying the agreed characteristics may be kept to ensure follow-up and proper execution of the order.
3.3. Taking measurements
For creations made to the customer's measurements, the measurements can be collected after the order has been validated.
Maison Distinguée provides the necessary information for their transmission and can assist the client in this process.
The information essential for production must be collected and verified before the launch of the operations concerned.
3.4. Payment
Payments are made using the methods offered on the website or through the payment solutions provided for personalized orders.
Any terms of staggered payment, deposit or settlement of the balance are specified before the client's final commitment.
Article 4 – Production, deadlines and delivery
4.1. Production and delivery times
Maison Distinguée creations are made to order, therefore they require a manufacturing time which varies depending in particular on the model, its complexity and the agreed personalizations.
The delivery time or date applicable to the order is communicated to the customer before its final validation.
For custom orders, this information is specified in the quote or in the special conditions accepted by the customer.
The tailoring process may require the prior transmission of all measurements and information essential for its completion.
In the event of a delay in providing these documents by the client, Maison Distinguée will inform her of the potential consequences on the agreed schedule. Any modification to the contractual deadline will be subject to an agreement between the parties, in accordance with applicable legal provisions.
4.2. Delivery address
Orders are shipped to the address provided by the customer when validating their order or in the information provided for a custom creation.
The customer is advised to carefully check the accuracy of the delivery details provided.
Any change of address must be reported to Maison Distinguée as soon as possible. Its processing depends in particular on the order's preparation and shipping status.
4.3. Delivery charges
Delivery costs are shown before final order confirmation.
They can vary depending on the destination, the characteristics of the package and the shipping methods offered.
Maison Distinguée may occasionally offer free delivery deals or special conditions, the details of which are specified at the time of the offer.
For international deliveries, customs duties, import taxes, or clearance fees may apply depending on the destination. The customer is informed, before placing the order, of any applicable additional charges or their potential payment when they cannot be calculated in advance.
4.4. Transport and reception
Maison Distinguée organizes the shipment of orders according to the terms agreed with the customer.
When delivery is made by a carrier proposed by Maison Distinguée, the risks of loss or damage remain with the Seller until the customer, or a third party designated by her, takes physical possession of the package, in accordance with applicable legal provisions.
In case of loss, damage or delivery difficulty, the customer is invited to contact Maison Distinguée so that a verification can be undertaken and a suitable solution sought.
4.5. Delivery Delay
In the event of a delay compared to the agreed date or deadline, Maison Distinguée informs the client and examines the possibilities of resolving the situation.
The customer retains the rights provided for by the Consumer Code, in particular the possibility, under legal conditions, of requesting delivery within a reasonable additional period or of terminating the contract.
When compliance with a date is an essential condition of the contract, the specific legal provisions relating to that deadline apply.
Article 5 – Client's Obligations and Responsibilities
The customer agrees to provide the information necessary for the processing and fulfillment of her order.
She is specifically invited to:
Check the specifications of the chosen model or project.
Provide accurate contact and delivery details.
Provide the measurements and information necessary for the garment's manufacture according to the instructions provided.
Report any significant changes that may affect the measurements or characteristics of the creation as soon as they become aware of them.
Maison Distinguée assists the client in the measurement process according to the proposed methods.
When measurements are provided by the client, their accuracy contributes to a good fit of the dress.
In case of difficulty in adjustment, the situation is examined with regard to the measurements provided, the instructions provided by Maison Distinguée, the agreed characteristics and the result delivered.
The responsibility for an error cannot be automatically attributed to the client simply because she has provided her measurements.
Upon receipt of the order, the customer is asked to examine the package and its contents and to report any anomalies found as soon as possible, including a missing, damaged or incorrect item.
This verification facilitates the processing of claims, but the absence of an immediate reservation with the carrier does not deprive the customer of her legal rights against the Seller.
Article 6 – Obligations and responsibilities of Maison Distinguée
Maison Distinguée undertakes to produce and deliver the ordered creations in accordance with the characteristics contractually agreed with the client and the applicable legal provisions.
The Seller undertakes in particular to:
Provide clear information about the creations, their essential characteristics and their price.
Communicate the applicable delivery times before the contract is concluded.
Provide the information necessary for taking measurements.
Ensure order follow-up according to the terms of the support offered.
Proceed with the shipment under the agreed conditions.
Handle claims in accordance with applicable legal guarantees.
In the event of a difficulty concerning an order, Maison Distinguée examines the situation based on the available information and the characteristics of the creation concerned.
When the delivered product has a non-conformity, the customer benefits from the remedies provided by the applicable regulations, regardless of the personalized nature of the creation.
Maison Distinguée remains responsible for the proper execution of its contractual obligations under the conditions provided by law, including when certain manufacturing, payment or delivery operations are carried out with the intervention of service providers.
Article 7 – Characteristics of creations and custom-made products
7.1. Characteristics of the creations
The essential characteristics of the creations offered by Maison Distinguée are presented on the product sheets or defined in the exchanges and contractual documents validated within the framework of a personalized order.
These may include, in particular:
The model and her silhouette.
Materials and colours.
The sleeves, the collar and the cut details.
Embroidery, lace and ornaments.
The length of the dress and train.
The planned accessories and customizations.
The individual measurements required for making the garment.
The price and included services.
7.2. Catalogue Models
The models presented in the catalogue are reference creations offered to order.
When a dress is ordered, it is made according to the individual measurements taken from the customer, in accordance with the operation of the made-to-measure service offered by Maison Distinguée.
Choosing a model from the catalogue does not necessarily mean purchasing an item that is already made and available in stock.
7.3. Fully customized creations
In the context of a personalized creation, the characteristics of the project are defined with the client before the final validation of the order.
The contractually approved elements serve as a reference for the creation of the dress.
Any significant modification requested after project approval may require a new feasibility study, as well as an adjustment of price or deadlines, subject to the agreement of the parties.
7.4. Photographs, sketches and final rendering
Photographs, videos, sketches and other visuals are intended to showcase the creations and illustrate their appearance.
Some differences in perception may result from lighting, screen settings, the movement of materials, or photographic rendering.
Slight variations inherent in individualized manufacturing may also exist, provided that they do not alter the agreed essential characteristics and do not constitute a lack of conformity.
These variations cannot justify a substantial difference in material, color, cut or finish compared to the contractually agreed characteristics.
7.5. Adjustment and measurements
The creation of a dress to the client's measurements is based on the measurements collected during the tailoring process.
Maison Distinguée provides the necessary information for their transmission.
When a difficulty in adjusting is reported after receipt, its origin is examined with regard to the validated measurements, the information provided, the manufacturing carried out and the respective obligations of the parties.
The customer's rights under legal guarantees remain applicable.
Article 8 – Right of withdrawal and personalized creations
8.1. Principle applicable to custom-made creations
In accordance with Article L.221-28, 3° of the Consumer Code, the legal right of withdrawal cannot be exercised for contracts relating to the supply of goods made to the consumer's specifications or clearly personalized.
Maison Distinguée offers wedding dresses made to order according to individual measurements and, where applicable, specific characteristics defined with the client.
When a dress is actually made according to the individual specifications of the customer or is the subject of a personalization meeting the conditions provided for by law, this exception to the right of withdrawal applies.
This rule can apply to both a completely original creation and a model from the catalogue, as long as the ordered item actually meets the legal criteria for personalisation.
The mere commercial presentation of an item as "made to measure" is not, in itself, sufficient to exclude the right of withdrawal.
8.2. Information before ordering
When an order falls under this exception, the customer is informed before validation of the absence of a legal right of withdrawal.
She is advised to carefully check the agreed specifications, the information needed for production, and the conditions applicable to her order.
8.3. Items not covered by the exception
When an item sold remotely does not meet the legal conditions allowing exclusion of the right of withdrawal and does not fall under another exception provided by law, the customer benefits from the applicable right of withdrawal, in particular the legal period of fourteen days under the conditions provided for by the Consumer Code.
8.4. Legal guarantees and defects of conformity
The absence of a right of withdrawal for a personalized creation does not deprive the customer of the applicable legal guarantees.
In the event of non-conformity, a defect affecting the contractually agreed characteristics or any other situation covered by legal guarantees, the customer retains the rights and remedies provided for by the regulations.
The procedures for making claims and implementing legal guarantees are specified in the relevant provisions of these General Terms and Conditions.
